By using this website or engaging Custom Indio Masonry for any masonry or contractor services, you agree to these terms and conditions in full. If you do not agree with any part of these terms, please do not use this website or engage our services. These terms apply to all visitors, customers, and anyone who requests or receives services from Custom Indio Masonry.
Custom Indio Masonry provides residential and commercial masonry and related contractor services in Indio, CA and the surrounding Coachella Valley area. Services include, but are not limited to, foundation repair, chimney repair, tuckpointing, brick and stone work, retaining walls, walkways, driveways, outdoor kitchens, and masonry restoration.
We reserve the right to decline any project at our sole discretion. Availability of specific services may vary based on location, scope, and scheduling.
Written estimates provided by Custom Indio Masonry are based on conditions observed at the time of the site visit and the information provided by the customer. An estimate is not a fixed-price contract unless explicitly stated in a signed written agreement.
Estimates are valid for 30 days from the date issued unless otherwise noted in writing. Prices may change after 30 days or if the scope of work changes.
Additional costs may arise if unforeseen conditions are discovered once work begins - for example, hidden structural damage, subsurface materials, or conditions not visible during the initial assessment. We will notify you of any additional costs before proceeding with work beyond the original scope.
Project start dates are estimates based on our current schedule and are not guaranteed. We will make reasonable efforts to begin and complete work within the timeframe communicated to you. Delays caused by weather, material availability, permit processing, or other factors outside our control are not grounds for cancellation or penalty.
If you need to cancel or reschedule a confirmed project, please notify us at least 48 hours in advance. Cancellations with less than 48 hours notice may result in a charge to cover mobilization costs already incurred.
We reserve the right to reschedule work due to unsafe weather conditions, crew availability, or other circumstances within our reasonable control. We will contact you as soon as possible to arrange an alternate date.
Payment terms will be specified in your written estimate or service agreement. Unless otherwise agreed in writing, the following general terms apply:
Unpaid balances that are 30 days past due may be subject to a late fee and may be referred to a collections process. You agree to reimburse any reasonable costs incurred to collect an unpaid balance, including attorney fees where permitted by law.

Custom Indio Masonry warrants that all work will be performed in a professional manner and in accordance with applicable building codes and industry standards. Any warranty specific to a project will be documented in the written service agreement for that project.
Warranty coverage does not apply to damage caused by: acts of nature (including earthquakes, floods, or wind events), improper maintenance by the customer after project completion, modifications made to our work by others, or conditions that were not disclosed to us before or during the project.
Material warranties, where applicable, are subject to the terms of the manufacturer or supplier and are not extended or modified by Custom Indio Masonry.

In all cases, our total liability to you for any claim arising from our services will not exceed the amount you paid us for the specific project giving rise to the claim.

If a dispute cannot be resolved informally, both parties agree to attempt to resolve the matter through mediation before pursuing any formal legal action. Each party will bear its own mediation costs unless otherwise agreed.
These terms and conditions are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal action arising from these terms or from services provided by Custom Indio Masonry must be brought in a court of competent jurisdiction located in California.
Custom Indio Masonry reserves the right to update these terms and conditions at any time. When changes are made, the effective date at the top of this page will be updated.
